PC 977 Waiver and Procedures

Good Friday Afternoon Everyone,

I was just forwarded some new procedures that have been implemented to handle some out of custody matters.

As for progress reports, still no procedure but one if forthcoming I will let you know as soon as I hear.

The court has now established a method of handling some out of custody issues, including those with warrants. So please have any clients needing reassignment, warrants handled, etc contact me and I will do the paperwork to get their case on calendar and assigned to an attorney. They will need to complete the attached PC977 waiver, as these matters will still be held without client. If there are matters that the atty can’t handle without the client there are procedures forthcoming.

Please have clients get up with me. email me the 977 and any report they may have to help request warrant recall. I’m still working from home so better to email as the fax is at the office.

Just wanted to drop a quick line to say there have been some procedures put in place to handle criminal protective order modification requests.

We can’t handle contested requests at this time and of course we don’t have anything to do with family court, or civil protective orders. If someone has a criminal protective order and a civil protective order (protecting the same person, or victim) we can request modification of the criminal order however given an existing civil order the parties still could not reunify.

If someone is wishing to request modification of their criminal order (and they have public defender) they can contact me. They will need to have completed double digits successful counseling sessions, not violated the order in the past six months, and have no new cases. I will need the contact information of the protected party. I will contact and ask if they are interested in modification. If they say no, conversation is over and we cannot move forward, I just thank them for their time and call is completed. If the protected party does want modification I have paperwork for both parties to complete and return to me. If the protected party is a minor I will need contact info for minor’s guardian. If there’s been a CPS investigation I will need paperwork showing cps is allowing contact with minor child or children.

As for review dates for court compliance documents, nothing has changed as of yet. I will need clients 977 waiver and progress report .
